‘개인정보’와 ‘사물정보’의 규제 차별성에 관한 연구

Abstract

A key element of IoT is 'information of things'. Restrictions on use of the 'information of things' itself is not specifically required. Rather, it should promote its use and distribution for the development of related services. However, due to the uncertainty of the boundaries of 'personal information' and 'information of things', the issues related to the regulation of personal information has been transferred to the regulation of 'informations of things'. Therefore this paper examine the deregulation area of 'information of things' to be free from the regulation of the 'personal informations'. To do that, the case of the IoT(Internet of Things) services were analyzed, these case studies clearly revealed issues relating to the distinction between 'information of things' and 'personal information' and the legislative measures were proposed to resolve them.
First, in order to clarify the distinction between regulated and deregulated areas, it shall modify the legal concept of 'personal information' in the direction of narrowing the scope of the concept. Next, the simple location information of the object is independent of the invasion of privacy, so it is necessary to exclude from the scope of the location information that is subject to regulation. Finally it is necessary to review the introduction of a legal system that is also exempt from liability, that means online service provider shall not be responsible for some infringement, where he/she meets all of the some requirements.
