Abstract
The government's amendment of the Occupational Safety and Health Act is not consistent with the systemic and logical principles of harmonization, nor is it consistent with the legislation of the Occupational Safety and Health Act. And it is highly likely that the law will become a slow-moving law, with many of the subjects of business owners' duty and health and safety management found to be smaller than the current law for no particular reason.
In particular, when it comes to subcontracting work, which focuses on social interest, the obligation to subcontractors, such as reducing and weakening the regulations on subcontractors and their effectiveness, is backward and insufficient.
The current government revision could seriously damage the credibility and normality of the Industrial Safety and Health Act, and even large corporations, let alone small and medium-sized businesses, cannot expect to adhere to the law faithfully. And the more serious problem is that it is difficult to expect effectiveness even in areas that have strengthened regulations.
Occupational Safety and Health Act, too, is not just about revising it, nor should it be content with it. The right legislation, or revision, that can effectively contribute to the prevention of industrial accidents should be made.
