Abstract

The ultimate goal of the autonomous police is to ensure the safety of the residents. Based on the current 「Police Act」, the autonomous police system, which is being implemented nationwide at the metropolitan level, is the core value of the Constitution: respect for human dignity and the maximum guarantee of basic rights. As there is a limit to realizing democratization, improvement measures were presented at the administrative and financial and legal level. The important results presented in this paper can be summarized as follows. First, expanding the introduction unit of the autonomous police to the city, county, and district base normalizes the limitations of the unified autonomous police system and secures public order near residents. It is necessary for the metropolitan police to be in charge of wide-area affairs related to living safety (wide-area traffic, wide-area multiple traffic enforcement events, etc.), and the local autonomous police to take charge of public order in the vicinity of residents. Second, It is necessary to clarify the matters that the 「Police Act」 stipulates that the investigation work is the work of the autonomous police. In fact, when a criminal case occurs in a region, it is necessary for the national police to mobilize in the case of affairs that must be concluded under the direction of the National Investigation Headquarters through cooperation between the national police and autonomous police at the 112 reporting stage. Third, in order for the autonomous police to operate normally, finances for the autonomous police must be secured. Local governments handle the affairs of the autonomous police as their own affairs, so local governments must finance their own budget. Fourth, new enactment of the tentatively named Autonomous Police Act should be carefully considered. The enactment of the new law can contribute to securing stable finances for the autonomous police and perfecting the form of affairs and organization, but at the same time, regulations from the central government may occur, which may cause infringement of the state's autonomy due to the execution of administrative police affairs.
