Abstract

The starting point of this study begins with the question of what is local welfare and what should be. With regard to Article 117 of the Korean Constitution, welfare for residents is by far the center of local administration. But it is unclear what welfare means in local administration and what is central. In response, this study suggests that the center of the welfare of residents is safety from disaster.
As an argument for the solution, the Constitutional Court first looked at what the purpose of local autonomy is to be set in the Constitution, and the development of local government through the Constitutional Court. In a modern country with a certain scale, the central administration and local administration must maintain mutual cooperation, noting that a country's administration is essentially a structure that can only be carried out with local help. In addition, the local administrative body looked into how the local government understood the welfare of residents and what the general provisions were. Based on Article 10 of our Constitution, we also emphasized that the central contents of the welfare of the people should be at least life and security of the people in relation to basic rights, and presented education and job status as the priority for the welfare.
Key considerations led to measures to protect residents from natural disasters that threatened their lives and safety. We concluded that the meaning of disasters in local administration, current legislation and administrative systems are properly structured and efficient for disaster prevention, and what improvements should be made to prevent and address disasters.
