Abstract

This study looks at the actual energy condition of nuclear power which is produced in the local governments. For this it is examined whether local authorities have adequate authority for nuclear safety.
Five chapters are formed for this purpose. In the Introduction why the purpose of the research is written. The second chapter looks at the production and supplying of energy produced in the marine environment. In the third we analyzed that what kind of structure does the atomic power law have, and its relationship between the central government and the local government in the applicable laws. The fourth chapter is the center of research, and in that measure are proposed to secure the right to vote in the region. In the fifth the contents is summed up.
In order to secure the right of the local governments the central government should basically recognize primarily safety, not economics for energy production. And he must secure local governments the autonomous right for nuclear power.
In this study five options are proposed to secure the security right of local governments to nuclear power.
First, the larger the risk, the more participation needed to participate in securing its safety. Local governments with nuclear facilities as part of their lives need to have a variety of laws to ensure nuclear safety because the risks of nuclear facilities are so higher than those in areas that do not.
Second, the central government should ensure the safety of nuclear plants in close proximity to regions of the country, even if the nuclear energy related statutes and local administrative law are the government's work. It is necessary to amend connected laws that local governments with nuclear facilities are excluded from the Nuclear Safety Act and the Radiation Protection Act.
Third, it was stressed the need to enhance transparency in nuclear power fields and its administration. To the extent that basic information on the causes of frequent outages of nuclear facilities, suppliers of such components to nuclear facilities, etc., should be made transparent to local residents, and to the extent that no leakage of national security technology occurs.
Fourth, as an nuclear power accident requires urgent actions, the heads of local governments should do priority actions and central government must respect the priority of safety measures by the local government.
The central government should respect the local governments when they are enforcing the security right to appoint or distribute safety. The central government can make up for the shortfall later on.
Fifth, voluntary activities by local government need to be encouraged so that they can monitor their own nuclear plant safety. Unless the prevention of nuclear power plant accidents is inefficient, it is necessary for the central and local governments to be carried out in a complementary relationship.
