Abstract
The innovation of technology and services in the era of the 4th industrial revolution raises questions about whether the current Copyright Collective Management system is still in effect. Various innovative technologies such as blockchain and artificial intelligence offer the possibility of individual management, and cases of individual manage- ment of music are already emerging. The copyright collective manage- ment system should be changed to reflect these environmental changes. It should be possible to create a virtuous cycle of use and creation of works by taking the lead in applying cutting-edge innovative techno- logies. However, the current centralized copyright management system has limitations in improving the competitiveness of the copyright industry in response to the fourth industrial revolution environment due to strong entry control by the government and strict legalization of business and service contents. Although rapid acceptance of technology and creation of innovative services are possible through competition, the basic government policy of centralized copyright management is the monopoly guarantee of a few consigned management companies through strict entry regulations.. In order for the “industrial revolution” of the Fourth Industrial Revolution to be triggered in the “copyright industry,” it is necessary to seek a fundamental change in the rules of entrusted management organizations. First of all, it is necessary to seek system improvement to secure effective competition in the copyright entrusted management market, assuming that the efficiency due to the'monopoly' that has been enjoyed so far is still not effective. It should be flexible to enter the market, encourage autonomy in pricing, and focus on post-supervision rather than pre-entry regulation.. It takes a certain period of time to achieve such an effective competition. As a short-term plan, it is necessary to create an environment in which innovative services can be proposed so that various choices of rights holders and users are guaranteed in the “trust”-centered copyright management market. To this end, this study, first, proposed to clarify the concept of 'comprehensive proxy' to prevent confusion among those subject to the law, and to introduce a 'Selective Management System'.
