Abstract


This paper aims at seeking fairness ways of the subcontract in public procurement. For this purpose author makes the paper concepts in five parts; in first part he sets the question about problems of unlawful subcontract in south korea. In the second part author display the european directives through that EU regulates its member states on public procurement field. In the third part the legal principles on the subcontract fairness in german procurement laws are researched. In the forth part author tries to find implications from the subcontract fairness institution in german law. In final author summaries contents and suggests some ideas.
The first suggestion is we need to consider building a awarding chamber through that bidder(tenderer) files a petition connected with public procurement. The second is that awarding giver should put a suitable procurement price. The third is that we should simplify the two-track legal system between the state contract act and the local government contract act. The forth idea is that current legal system needs specialties, capacity ability for accomplishment of building measure and suitability for subcontract fairness. The last suggestion is needed of consideration of environmental and social small enterprises.
